Allspaces.com reserves the right to change the terms, conditions, and notices under which this Web site is offered at any time. Modification of this contract will be deemed effective upon publication on the Web site with respect to any Renters or Lessor actions, communications or transactions occurring after said date. It is your responsibility to check terms and conditions of this Agreement at the time of each use. Your continued use of the Allspaces.com Web Site after the posting of the amended Terms of Use constitutes automatic acceptance of the amended Terms of Use. You may only amend these Terms of Use with a written agreement signed by both of Allspaces.
11. GOVERNING LAW AND JURISDICTION: The Allspaces.com web site (excluding linked sites) is operated by Allspaces from Allspaces offices in Massapequa Park, New York, USA. It can be accessed from all 50 states in the United States, as well as from other countries around the world. As each of these places has laws that may differ from those of New York, USA, by accessing the Allspaces.com web site, you agree that these Terms of Use and your use of the Allspaces.com web site shall be governed in all respects by the internal substantive laws of the State of New York, United States of America, without regard to conflict of laws provisions. You further submit to jurisdiction and venue in the courts located in New York and further agree that any cause of action you may bring arising under your use of the Allspaces.com web site shall be brought by you exclusively in a court located in New York Allspaces.com makes no representation that materials on the Allspaces.com web site are appropriate or available for use in other locations, and accessing them from territories where their contents are illegal is prohibited.   INDEMNIFICATION: You agree to defend, indemnify and hold Allspaces.com, and its subsidiaries, affiliates, officers, agents, directors, co-branders and employees or other contracting parties, and their respective officers, directors, employees, agents, and contractors, harmless from any claim, loss, action demand, suit, loss, damage, injury or liability of any kind including, without limitation, reasonable attorneys' fees, collectible loses, made by any third party due to or arising out of or in connection with your Content, your use of the Service, your violation of these terms of use, or your violation of any rights of another including, but not limited to claims under the Fair Housing Act.
  ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS OF SERVICE: Allspaces.com is a prepaid rental listing service. Allspaces is licensed by the New York Department of Real Estate. Allspaces.com hereby agrees to furnish prospective tenant, for the term of this contract, rental information consisting of referring the prospective tenant to landlords or property agents who have reported available rentals to Allspaces. Allspaces.com makes an honest and diligent effort to acquire accurate information furnished by the landlords or property agents. The greater portion of Allspaces.com information is obtained via the internet. Therefore, representation and description of rentals will reflect the information given to Allspaces.com by the landlord or property agent. Accordingly Allspaces cannot be held responsible for the accuracy of property descriptions or conditions. Due to the nature of the real estate market, all listings are subject to prior rental. Currently the Apartment services on the Allspaces.com web site is at the following rates:

  You are responsible for paying any applicable fees and taxes and for all hardware, software, service and other costs you may incur in connection with the Services, including costs incurred in connecting to the Sites via the Internet. Allspaces.com reserves the right, at any time, to charge or modify fees for access to the Sites or for any of its Services. Allspaces.com will notify you of any such fees by posting information regarding such fees on the Sites.
  REFUNDS AND CANCELLATIONS: You may cancel your Allspaces.com subscription at any time by logging into your account and selecting the "Deactivate Account" tab from the Navigation Bar. Because Allspaces provides you with the opportunity to preview all content on the site at no cost and only require payment when you wish to contact landlords, Allspaces does not offer refunds of purchased time (Note 1). In addition, because Allspaces offers substantial price discounts for subscribers who purchase longer-term use plans, Allspaces do not offer refunds for "unused" subscriber time.
  In certain situations, subscribers may be eligible for extended terms of service with Allspaces.com, or discounted/free membership with another service within the Allspaces.com network.

  5.(a) An apartment information vendor may retain not more than $15 dollars out of any advance fee for administrative services. The balance of the advance fee shall continue to be the property of the person paying the advance fee...
  (b) If the customer pays an advance fee, the contract with the apartment information vendor shall contain a provision stating that the customer may, under the circumstances set forth in this paragraph, recover his advance fee less the amount deducted for administrative services. The vendor shall be entitled to his fee when a customer has leased or rented a private dwelling, abode or place of residence through the information provided by the vendor. Within 10 days of the receipt by the apartment information vendor of written notice stating that the customer paying an advance fee has not leased or rented a private dwelling, abode or place of residence through the information supplied by the vendor and does not intend to rent any such private dwelling, abode or place of residence, the vendor shall refund the advance fee, less the fee for administrative services, to such customer." Notwithstanding anything in this subdivision 5 to the contrary, if the services to be rendered by the apartment information vendor to a particular customer relate exclusively to acting as an apartment sharing agent, the vendor may retain the full advance fee, whether or not the customer leases or rents a private dwelling, abode or place of residence through the information provided by the vendor, and the provisions of paragraphs (a) and (b) of this subdivision five shall not be applicable to such transaction."

  "(a)(1) A licensee shall refund in full the fee paid by a prospective tenant if the licensee does not, within five days after execution of the contract, supply at least three rental properties then available to the prospective tenant and meeting the specifications of the contract, unless the prospective tenant obtains a rental through the services of the licensee.
  (2) A licensee will be deemed to have supplied information meeting the specifications of the prospective tenant if the information supplied meets the contract specifications with reference to: (i) type of structure; (ii) designate area; (iii) furnished or unfurnished; (iv) number of bedrooms; (v) maximum rental; and (vi) any other specification expressly set forth in contract. A demand for the return of the fee shall be made by or on behalf of the prospective tenant within 10 days following the expiration of the five-day period referred to above by delivery or by mailing by registered or certified mail to the address of a location, or branch office of a real estate broker, set forth in the contract.
  (b)(1) Except as provided in paragraph (3), a licensee shall refund any fee paid over and above the sum of a fifty dollar ($50) service charge to the prospective tenant if the prospective tenant obtains a rental other than through the services of the licensee during the term of the contract or does not obtain a rental, provided that the prospective tenant demands a return of that part of the fee within 10 days after the expiration of the contract."
  In accordance with the articles detailed above, New York and California customers may request a refund (less $15 in New York, and less $50 in California) of the advance fee. In order to request a refund of the advance fee, customers must do the following: PROCEDURE FOR OBTAINING A REFUND
  (6) It is understood and agreed that the customer has an absolute right to receive a refund of the full advance fee if he or she follows the following directions:
  This notice must be in writing, signed by the customer, and sent via first class or registered mail. A copy of the customer's new lease, or a renewal lease, must accompany the notice.
  a. The customer will receive a refund when the vendor is notified that the customer has not leased or rented and does not intend to rent or lease an apartment, or other residence, through information supplied by the vendor.
  b. The notice must be in writing notarized and signed by the customer.
  c. The notice may be delivered to the vendor either in person or by first class mail to the vendor's address set forth above.
  (7) The vendor shall refund the advance fee, less the fee for administrative expenses set forth in paragraph (2)above, within 10 days of receipt of the notice; and the customer shall NOT be required to present evidence that he or she actively pursued the information supplied by the vendor to be eligible for a refund.
  (8) The vendor agrees to be personally responsible and liable for carrying out the terms of this escrow agreement.

  ENTIRE AGREEMENT: The provisions and conditions of these Terms and each obligation referenced hereto represent the entire Agreement between Allspaces.com, its affiliated or related entities and you. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. In the event inconsistencies exist between these Terms and any future published Terms or understanding, the last published Terms shall prevail. Allspaces.com is licensed as a Apartment information vendor in the State of New York and those states where it believes it may be necessary to do so in order to comply with state regulations. While Allspaces.com is licensed, Allspaces.com does not render legal, brokerage, or other professional advice or services to either its Renter or Lessor customers.
