| 1. |
AUTHORIZATION:
I hereby authorize Allspaces.com NY Corp
and Allspaces.com to charge my
credit card to receive a tenant resume,
use of appointment scheduler, apartment
information and have access to Customer
Support. Client has tendered to Allspaces.com,
$50.00 (30 day subscription) $75.00
(60 day subscription) or $125.00 (180
day subscription) the receipt of which
is hereby acknowledged. It is agreed
that this constitutes appointment service
payment for services described in this
contract. Allspaces.com is a
rental listing service in the business
of supplying prospective tenants with
listings for residential real estate
properties for tenancy. Allspaces.com
agrees to make available to Client via
the Internet, listings obtained by Allspaces.com
of residential units available for rental.
It is agreed by both Allspaces.com and
Client that only the named Client is
entitled to the service provided by
Allspaces.com. Allspaces.com does not
represent or act as agent on behalf
of the owner(s) of the properties listed
and made available to the Client. Allspaces.com
does not guarantee the accuracy of information
provided by owners, managers, agents,
or representatives of any residential
unit listed by Allspaces.com and made
available to Client as to said property
listed. Allspaces.com promises, however,
to make every good faith effort feasible
to ensure the accuracy of information
provided to Client. Allspaces.com does
not promise Client that Client will
enter into agreement with any owner
of any property listed by Allspaces.com
for the rental of any residential unit.
It is agreed by both Client and Allspaces.com
that the service provided by Allspaces.com
to Client is limited to providing information
to Client as to residential units reasonably
believed to be available for rental.
Allspaces.com promises to make every
good faith effort feasible to ensure
that only current and up-to-date listings
are provided to Client. |

UPDATES & AVAILABILITY:
There are 5 ways you can receive your
listing information:
A. Updates are available through Internet
access. Of course, Internet access may
be affected by routine database maintenance
and by Internet carrier disruptions.
B. You will also receive emailed updates
on all new listings that match your
profile.
C. You can use our online operator to
assist you in obtaining listing information
at any time.
D. You may also call Customer Support
at (516) 798-1600 for listings information
if you have no access to your web or
email account.
E. You may also visit our office without
appointment 7 days per week during normal
business hours to receive a printout
of your listings. |

GENERAL DISCLAIMER: Due to
the nature of a fluctuating marketplace,
and your specific search parameters,
(such as size, price, location, etc.)
on any given day, your updates may or
may not include new listings. Allspaces.com
cannot be held responsible for the look,
nature, size, and layout of apartments
or the condition they are delivered
in. Allspaces.com. is not responsible
for any errors or omissions in listing
information. All information was gathered
from sources deemed to be reliable.
Allspaces.com operates solely as a licensed
Apartment Information Vendor, not as
a licensed Real Estate Broker. Allspaces.com.
reserves the right to terminate any
account for misuse of the listings information. |

APARTMENT ACCESS: Allspaces.com
makes every effort to maintain the most
current access information. However,
persons involved in granting access
to apartments are employees or agents
of the landlord Allspaces.com has no
control over their helpfulness or cooperation
with you. Therefore, Allspaces.com shall
not be held liable for any difficulty
or disappointment as it relates to any
aspect of access to apartments. |

SERVICE PERIOD: Service is
good until you find an apartment or
your subscription expires, whichever
comes first. Client and Alllspaces.com
do agree that the previously stated
sum tendered to and accepted by Allspaces.com
entitles Client to receive information
from Allspaces.com for the agreed upon
period of either 30, 60 or 180 days,
beginning with the date of payment.
Company promises Client to be open for
business a reasonable number of hours
each week and does further promise to
make available to Client all selected
listings processed at that time or as
frequently as desired by Client during
tenure of this agreement. The purchase
of any goods and services other than
the provision of listings of residential
real properties for tenancy is optional.

SUSPEND SERVICE: You may request
a one-time suspension of your account
for up to 4 months. At the end of the
suspension period your account automatically
becomes active again for the balance
of the service period. |

| 7. |
SERVICE CHARGE: The cost of
the appointment service plan (a) is
a total of $ 50.00 plus Transaction Fee
tax of $4.25, plan (b) is a total of
$75.00 plus Transaction Fee of $6.37,
plan (c) is a total of $ 125.00 plus
Transaction Fee of $10.62. In no
event will you be charged more than
$135.62 for the appointment service.
You will pay this appointment service
charge at the start of your subscription.

REFUND POLICY: It is your
right to apply for a 50% refund during
the first five (5) days of service.
If you have rented an apartment through
our service, you are not entitled to
any refund, even if you found the apartment
on the 1st day of service. You may fax
(516-798-8300) or email us (Refund@Allspaces.com)
your intent to request a refund. We
will inactivate your account as of the
date we receive the email or fax, but
you must still send us your refund request
by mail. Your request for a refund must
be in writing and signed by you, the
Customer. No refunds will be made unless
we have officially received your signed
refund request by mail. Upon receipt
of your request, you will receive an
email detailing the full procedure for
obtaining your refund. Including but
limited to reasonable documentation
of the prospective tenant's new rental
or of the fact that the prospective
tenant did not move, such as a lease,
rental agreement, or utility bill, with
sufficient information to verify that
the new rental was not obtained through
the services of the licensee or that
the prospective tenant did not move,
or (ii) if the prospective tenant is
unable to locate or provide that documentation,
the prospective tenant may, at his or
her option, fill out a written form
provided by the licensee and signed
by the prospective tenant under penalty
of perjury stating that he or she did
not obtain a rental through the services
of the licensee during the time of the
contract. To be entitled to a refund
in excess of the service charge the
prospective tenant must mail or deliver
the demand for refund not later than
ten (10) days after the expiration of
this contract, and must supply either
(i) reasonable documentation of the
prospective tenant's new rental or of
the fact that the prospective tenant
did not move, such as a lease, rental
agreement, or utility bill, with sufficient
information to verify that the new rental
was not obtained through the services
of the licensee or that the prospective
tenant did not move, or (ii) a written
form provided by the licensee and signed
by the prospective tenant under penalty
of perjury stating that he or she did
not obtain a rental through the services
of the licensee during the time of the
contract. The documentation may be supplied
after the demand for a refund is mailed
or delivered, provided that it is supplied
within a reasonable time after it becomes
available. Allspaces.com reserves the
right to request and verify your address
for a period of up to 3 months from
the time that you cancel service. You
agree to furnish proof of current residence
address, or forfeit any refund that
might otherwise be due to you. If we
have refunded you money and later discover
that you have moved into a property
in our landlord inventory, we reserve
the right to re-charge you the refunded
amount. |

ALL SALES ARE FINAL: By registering,
I affirm that I have read, understood
and will comply with the policies of
Allspaces.com. The listing information
being provided to client pursuant to
this contract is considered proprietary
and confidential by Allspaces.com. Client
agrees that Client will use it for the
sole purpose of locating a rental unit
for personal use and will otherwise
keep it confidential and not disclose
it to third parties without Allspaces.com’s
prior written authorization. Allspaces.com
may pursue available legal remedies
for the unauthorized use or disclosure
of listing information provided under
this contract. I further affirm that
I am not: 1) misusing this information,
or 2) gifting or selling this information
to anyone that will not be living in
the same apartment as me, 3) reselling
any of the information obtained herein,
or 4) that I am not a real estate broker
or agent using this accessed information
for professional purposes unless I have
made prior written arrangements with
Allspaces.com. You may bring a small
claims court action against the licensee
for her/his refusal to make a refund
on your demand of all or part of the
fee paid by you under this contract.
If the court finds that the licensee
has acted in bad faith in refusing to
make the refund, the court has the authority
to award you up to five hundred ($500)
in addition to damages actually sustained
by you. A person who purchases rental
information for purposes other than
that of locating a rental unit for personal
use or the use of a designated person
shall not be entitled to the return
of any part of the fee paid to the licensee.
The liability of Allspaces.com is limited
to the fee paid by you. Allspaces.com
reserves the right to terminate any
account for violation of any of the
Terms of Service. |
